I think you are misunderstanding what bailout means in this case. The money set aside for catastrophes like this are designed to compensate people and businesses who have been affected, such as fisheries and wildlife habitats. It is not used to compensate BP to clean up their own mess. BP is only liable for up to 75 million in damages, but they are fully financially responsible to clean up and contain the mess. And because of the difference in liability, they have an additional tax of 8 cents for every barrel they produce here or import into the US.

The added gas tax for us would add around one tenth of one percent to the price of oil.

Now BP's CEO admits liability and promises to pay for the cleanup, but their attempt to get people to sign agreements not to sue in exchange for $5000 sort of contradicts that.
