Quick technical explanation: As most of the unlicensed NES games simply had a hack/bypass for the 10NES protection chip, this game uses the chip from a real game. Hence... the need for a real one to make it work and why it works in the toploader NES. (The toploader has no 10NES and is immune to the blinking screen of annoyance)
